4 years ago on 23rd June 2016 the United Kingdom voted to leave the European Union.
Changes in employment rights start to apply from 1st January 2021 with changes applicable from 1 July 2020 in relation to right to work checks for EU citizens.
There will be no change to right to work checks until 1 January 2021 and you will not be required to undertake retrospective checks on existing EU employees.
Right to work checks
Job applicants can prove their right to work using:
- their valid passport or national identity card if they’re an EU, EEA or Swiss citizen
- their valid biometric residence card if they’re a non-EU, EEA or Swiss citizen family member
- their status under the EU Settlement Scheme using the Home Office’s online right to work checking service
So, citizen of the EU, Iceland, Liechtenstein, Norway or Switzerland, can still show identity documents to prove their rights in the UK until 30 June 2021.
UK Business, employers and HR teams need to consider the changes to their arrangements for 2021.
Business and systems processes will need to be reviewed and updated to ensure that appropriate measures are put in place to to undertake the legal right to work obligations. It is only a year away.
